General Terms and
Conditions
Welcome to the Lipedema Rebel website founded by Silvia Fejesova the Lipedema patient and Lipedema mentor at the same time.
By using our mentoring services, you agree to the following terms and conditions:
1. Scope
These General Terms and Conditions (GTC) govern the contractual relationship between Lipedema Rebel/Silvia Fejesova (Provider) and its clients in the context of Lipedema mentoring services. They apply to all services provided by the Provider, whether in person, online, or via any other means of communication.
2. Services and Responsibilities
The Provider undertakes to provide mentoring, accompaniment, and training services in a professional manner and in compliance with applicable standards. However, the Provider does not guarantee specific results or successes and cannot be held responsible for failure to achieve the objectives set by the Client. Any liability for direct or indirect damages in its Lipedema treatment path is excluded. The Provider is not a doctor or healthcare professional and therefore does not provide medical diagnoses or medical advice on your health conditions. The Provider brings its own experience with Lipedema, which can be motivating for the Client who will have to independently seek the treatments that best suit him/her and the doctors to whom he/she will have to turn. The Provider has no responsibility for the Client's health conditions before, during, and after the mentoring and training service.
3. Confidentiality and data protection (Swiss GDPR)
The Service Provider undertakes to respect the confidentiality of the information shared by the Client in relation to the services. The personal data collected during the performance of the services will be processed in accordance with the Swiss Federal Act on Data Protection (LPD) and the General Data Protection Regulation (GDPR) applicable in Switzerland.
Nature of the data collected: The Service Provider collects only the information necessary to provide the services (name, contact details, preferences, etc.).
Purpose of the processing: The data is collected and processed for the sole purpose of providing the agreed services.
Customer rights: The Client has the right to request access to, rectification or erasure of their personal data, as well as to object to their processing.
Transfer of data: The data will not be shared with third parties unless with the express consent of the Client or if required by law. Please consult our privacy policy.
4. Financial conditions
Prices: The prices of the services are indicated on the website of the Service Provider or communicated to the Customer before purchasing the service.
Payment: Payment for the services is made according to the methods agreed in the contract (bank transfer, credit card, etc.). Payment is generally due before the start of the service, unless otherwise agreed.
Late payment: In the event of late payment, the Service Provider reserves the right to suspend the services until payment is made. Reminder costs may apply.
5. Cancellation and modification of services
Cancellation by the Client: The Client may cancel a mentoring session with 24 hours’ notice. After this period, the service will be invoiced in full, and no payment made prior to the mentoring session will be refunded.
Cancellation by the Provider: The Provider reserves the right to cancel or postpone a session in the event of force majeure or unforeseen circumstances. The Client will be informed as soon as possible, and a new date will be agreed.
Changes to services: Any changes to services must be agreed in writing by both parties.
6. Intellectual Property
All content, tools, and documents provided as part of the mentoring and accompaniment, and training services are protected by copyright. The Client undertakes not to reproduce, distribute, or use them for commercial purposes without the prior written consent of the Provider. Financial compensation will be required for any infringement.
7. Right of withdrawal (Online Commerce)
For subscriptions, in accordance with the Swiss law on electronic commerce, the Customer has the right to withdraw from the contract within 30 days of confirmation of the order, without having to provide any reason. To exercise this right, the Customer must communicate the withdrawal in writing (by e-mail or regular mail). The right of withdrawal applies only to services ordered online.
8. Termination of the Agreement
The agreement may be terminated by the Client or the Service Provider at any time with 24 hours’ notice for individual sessions and 30 days’ notice for mentoring subscriptions. The Client is responsible for payment for the services provided up to the date of termination. Payments already made are non-refundable.
9. Force Majeure
The Supplier shall not be held liable for any delay or failure to fulfill its contractual obligations in the event of force majeure, that is, any unforeseeable, unavoidable event beyond its control, such as natural disasters, pandemics, strikes, or government measures.
10. Applicable law and competent court
These General Conditions are governed by Swiss law. In the event of a dispute, the parties undertake to seek an amicable solution. In the event of failure to reach an agreement, the competent court will be that of Geneva, unless otherwise provided by law.
11. Modification of the General Conditions
The Supplier reserves the right to modify these General Terms and Conditions at any time. The new General Conditions will come into force upon publication on the Supplier's website. The Customer will be informed of any significant changes. In the absence of objections within 30 days, the changes will be considered accepted.
